Background on Oklahoma’s Sexual Assault Kit Tracking System

Established in July 2019, a new section of law was codified in the Oklahoma Statutes that requires all sexual assault kits collected on, or after, October 1, 2019 – where consent for forensic analysis has been given to be submitted to law enforcement for forensic testing within 20 days of receipt.

The Oklahoma State Bureau of Investigation has implemented Senate Bill 967 (2019 Legislative Session), which created 74 O.S. § 150.28a – Statewide sexual assault kit tracking system. The tracking system provides sexual assault survivors with the ability to anonymously track the location and status of their Sexual Assault Kit (SAK) from the point of collection through forensic analysis to final storage location and possible destruction.

Senate Bill 967
Oklahoma Senate Bill 967 created 74 O.S. § 150.28a – Statewide sexual assault kit tracking system, which directs the Oklahoma State Bureau of Investigation’s (OSBI) Criminalistics Services Division to develop a statewide electronic tracking system for rape kits including those found in the 2017 statewide audit. The system, which would be accessible for victims, would track a kit’s location and whether it has been processed. Law enforcement agencies, forensic labs, medical providers and others who have custody of rape kits would be required to participate in the tracking system.

Senate Bill 975
Oklahoma Senate Bill 975 created 74 O.S. § 150.28b – Statewide sexual assault kit tracking system, which directs accredited crime laboratories to provide Oklahoma law enforcement agencies with the same standardized sexual assault evidence kit. Currently, three different kits are used throughout the state. Agencies must submit the kit to a laboratory within 20 days of receiving it if the victim filed a report with law enforcement or requested it to be processed. Alleged sexual assault victims must be informed of the kit’s purpose and his or her right to have it tested. The bill also requires agencies to keep kits for up to 50 years or for the length of the crime’s statute of limitations, whichever is longer. Amended by Laws 2023, c. 130, s. 1, eff. 11/1/2023, OSBI can inquire as to the condition and location of a sexual assault evidence kit that has not been submitted to a forensic laboratory within the established deadlines.

Senate Bill 975
Oklahoma Senate Bill 975 created 74 O.S. § 150.28c – In addition to guidelines and procedures for the collection, submission and testing of DNA evidence that is obtained in connection with an alleged sexual assault, the Oklahoma State Bureau of Investigation (OSBI) and each accredited crime laboratory within the State of Oklahoma in partnership with the Oklahoma Sexual Assault Forensic Evidence Task Force shall implement a priority protocol for the testing of untested sexual assault evidence kits as outlined in 74 O.S. § 150.28c. Amended by Laws 2023, c. 130,s. 2, eff. 11/1/2023, OSBI may initiate an investigation on any previously untested or partially tested sexual assault evidence kit once testing has been completed.

Sexual Assault Tracking System
The Sexual Assault Kit Tracking System provides sexual assault survivors with the ability to anonymously track the location and status of their Sexual Assault Kit (SAK) from the point of collection through forensic analysis to final storage location and possible destruction.  The system is designed to track sexual assault kits collected in Oklahoma.  The goal of the system is to empower survivors with information and create transparency to foster public trust. 

Individuals with Log-In Credentials
Survivors will be able to anonymously login to the Oklahoma Sexual Assault Kit (SAK) Tracking System to track the status and location of their SAK, using the login credentials provided to them at the time of collection of the SAK at the Medical Facility.
